ArtemisChat Terms of Service

1. Description of Service

ArtemisChat is a multilingual conversation platform that enables:

• Public discussion rooms organized by topic, country, or interest
• Direct private messaging between users
• Participation in conversations while reading and replying in the user’s own language
• Discovery of public conversations from around the world

ArtemisChat provides communication infrastructure only.

ArtemisChat:

• Provides tools that allow people to communicate across languages
• Does not provide professional translation services
• Does not guarantee the accuracy of automated language outputs
• Does not act as a publisher or professional advisor

You are solely responsible for your use of the Service.

2. Eligibility & Authority

You represent and warrant that:

• You are at least 18 years old (or the age of majority in your jurisdiction).
• You have full authority to enter into binding agreements.
• If using the Service on behalf of an organization, you have authority to bind that organization.

You are responsible for all activity conducted under your account.

3. Account Security

You agree to:

• Maintain the confidentiality of your credentials
• Use strong passwords and enable security features where available
• Immediately notify us of unauthorized use

We are not liable for losses resulting from unauthorized access caused by your failure to secure your account.

3.1 Username Reservation and Reassignment

ArtemisChat reserves the right to reclaim, reassign, or remove usernames that violate platform policies, impersonate individuals or organizations, infringe on trademarks, or create a risk of user confusion.

4. Subscriptions, Fees & Billing

4.1 Subscription Plans

ArtemisChat is currently offered without paid subscriptions.

4.2 Free Trials

Certain features may become paid in the future.

4.3 Automatic Renewal

If paid features are introduced, these Terms of Service will be updated.

4.4 No Refunds

Users will be notified before any charges apply.

5. Acceptable Use

You agree not to use the Service to:

• Violate any law or regulation
• Harass, threaten, abuse, or intimidate other people
• Post hate speech, extremist content, or material that incites violence
• Impersonate another person or use deceptive identity practices
• Transmit unlawful, fraudulent, defamatory, or otherwise harmful content
• Infringe intellectual property rights
• Coordinate manipulation campaigns, spam, or inauthentic engagement
• Distribute malware, phishing attempts, or harmful links
• Upload, store, or distribute illegal content
• Attempt to bypass platform safeguards or interfere with platform security
• Scrape the Service or use automation in a way that abuses the platform

You are solely responsible for all content transmitted or stored.

We may remove content, restrict access, or suspend or terminate accounts that violate these rules or threaten platform safety.

6. User Content & Data

You retain ownership of content you upload, send, post, or otherwise transmit through the Service.

By using the Service, you grant ArtemisChat a limited license to:

• Host
• Display
• Process
• Store
• Transmit
• Distribute

your content solely as necessary to operate, maintain, improve, and secure the Service.

Content posted in public rooms may be visible to other users and to visitors who can access public conversations.

You should avoid posting sensitive personal information, confidential materials, or other information you do not want exposed in public rooms.

You are responsible for ensuring your use of the Service complies with:

• Applicable confidentiality obligations
• Professional or organizational rules that apply to you
• Data protection laws

We may moderate, remove, restrict, or review content as needed to maintain platform safety, enforce these Terms, comply with law, or prevent abuse.

7. Language Processing Disclaimer

ArtemisChat uses automated language-processing systems to present conversations in different languages.

These outputs may be imperfect, incomplete, or context-sensitive.

You acknowledge:

• Language outputs are generated by automated systems.
• Language outputs may be inaccurate, incomplete, or contextually incorrect.
• ArtemisChat makes no representation or warranty regarding the accuracy of automated language outputs.

Users should not rely on automated language outputs for critical decisions without independent verification.

8. Security

We implement commercially reasonable safeguards, including:

• Encryption in transit (HTTPS)
• Encryption at rest (where supported)
• Access controls
• Monitoring systems

We use reasonable technical and organizational safeguards designed to protect the Service and user data. However, no system can guarantee absolute security.

We are not liable for unauthorized access beyond our reasonable control.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTEMISCHAT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY
• RELIABILITY
• UNINTERRUPTED SERVICE
• LANGUAGE-PROCESSING ACCURACY

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, CONTINUOUSLY AVAILABLE, SECURE, OR FREE FROM LANGUAGE-PROCESSING ERRORS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

ARTEMISCHAT SHALL NOT BE LIABLE FOR:

• INDIRECT DAMAGES
• INCIDENTAL DAMAGES
• CONSEQUENTIAL DAMAGES
• SPECIAL DAMAGES
• LOST PROFITS
• LOSS OF DATA
• BUSINESS INTERRUPTION

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID TO ARTEMISCHAT IN THE PRECEDING SIX (6) MONTHS, OR
(B) $100 USD.

Some jurisdictions do not allow certain limitations; in such cases, liability is limited to the maximum permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Artemis Systems, LLC and its affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your content
• Your violation of these Terms
• Your violation of law or third-party rights

12. Termination

We may suspend or terminate your account for:

• Violation of Terms
• Fraud
• Security risks
• Abuse of the platform
• Conduct that threatens users, public conversation spaces, or platform safety

You may terminate your account at any time.

Suspension or termination does not limit any other rights or remedies available to ArtemisChat under these Terms or applicable law.

13. Dispute Resolution & Arbitration

13.1 Informal Resolution

Before filing any claim, you agree to attempt informal resolution by contacting:

13.2 Binding Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Arbitration shall take place in Delaware, United States.

Judgment on the award may be entered in any court of competent jurisdiction.

13.3 Class Action Waiver

YOU AGREE THAT ANY CLAIM SHALL BE BROUGHT ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.

13.4 Jury Trial Waiver

YOU WAIVE ANY RIGHT TO A JURY TRIAL.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

15. Changes to Terms

We may update these Terms at any time.

Updated Terms will be posted with a revised “Last Updated” date.

Continued use of the Service constitutes acceptance of the updated Terms.

16. Privacy
